I have the honour to acknowledge the
receipt of your Despatch No. 124 of the 29th. May regarding
the roofing material supplied by the Horseley Company to the
Railway Department.

It is admitted that the material supplied
wos inferior to the material specified; but the Horseley
Company deny liability on the ground that they bought on an
approved sample and that the sub-contractors supplied sheeting
to simple, which was passed by the Crow Agents' Inspector.
3.
There would seem to be no good reason why
this Government should suffer loss on that account; and, as
the action of the Crom Agents' Inspector appears to constitute
an effective bar to further action against the Company, I
would ask that the Crown Agents may be required to reimburse
this Government in the difference between the £60 recovered
and the total expenditure incurred on this worthless roofing
material.
